• Consent (Section 19): You have submitted our contact form and given consent for us to process your information and follow up with you.
• Contractual necessity (Section 24(3)): Processing is necessary to take pre-contractual steps at your request (e.g. preparing a product proposal or demo).
• Legal obligation (Section 24(1)): We may process data to comply with Thai law or regulatory requirements.
• Legitimate interests (Section 24(5)): Where other bases do not apply, we may rely on our legitimate interest in operating and improving our business, provided this does not override your fundamental rights.

4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

This section applies to a feature that is not currently active but may be introduced in the future.

If we offer social media login (e.g. via Google, Facebook, or LINE), and you choose to use it, we may receive certain profile information from your social media provider. This may include your name, email address, and profile picture.

We will only use this information for the purposes described in this Privacy Notice. We are not responsible for how your social media provider handles your data. We recommend reviewing their privacy policy before connecting your account.

This Privacy Notice will be updated when this feature is activated.

7. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?

Our website is hosted in Thailand through HOSTATOM, a Thai-based hosting provider. Your data is primarily stored and processed in Thailand.

However, some of the third-party tools we use (such as Google Analytics and HubSpot) may process data on servers located outside of Thailand. Where such transfers occur, we take steps to ensure your data is protected in accordance with the PDPA and applicable data protection standards.

As noted in our Terms and Conditions, by using our Services, you consent to the transfer and processing of your data in Thailand and in countries where our third-party providers operate.

8. HOW LONG DO WE KEEP YOUR INFORMATION?

We retain your personal information only for as long as necessary to fulfil the purposes described in this Privacy Notice, or as required by Thai law.

In general:

• Inquiry and contact form data is retained for as long as necessary to fulfil the purpose for which it was collected, or until you request deletion.
• Analytics and technical data is retained in accordance with the default retention settings of each third-party tool, and for no longer than necessary for the purposes described in this Notice.

When your information is no longer required, we will securely delete or anonymise it. If deletion is not immediately possible (e.g. data stored in backup archives), we will isolate it from further processing until deletion can be completed.

9. DO WE COLLECT INFORMATION FROM MINORS?

Our Services are directed at business professionals and corporate decision-makers. We do not knowingly collect personal information from individuals under the age of 18.

If you are under 18, please do not submit any personal information through our Site. If we become aware that we have inadvertently collected information from a minor, we will promptly delete it.

Please note that some rights may be subject to limitations under Thai law, and we may need to verify your identity before processing a request.

11. CONTROLS FOR DO-NOT-TRACK FEATURES

Some web browsers allow you to activate a Do-Not-Track (“DNT”) signal to indicate that you do not wish to have your online activity tracked.

Currently, no uniform technical standard exists for recognising and responding to DNT signals. As a result, we do not respond to DNT browser signals at this time. If a recognised standard is adopted in the future, we will update this Notice accordingly.

You may manage your tracking preferences through our Cookie Notice or by adjusting your browser settings.

12. DO WE MAKE UPDATES TO THIS NOTICE?

We may update this Privacy Notice from time to time to reflect changes in our practices, legal requirements, or the features of our Site. The updated version will be indicated by the “Last updated” date at the top of this Notice.

14. HOW CAN YOU REVIEW, UPDATE, OR DELETE YOUR DATA?

You have the right to request access to, correction of, or deletion of the personal information we hold about you, subject to applicable law.

To submit a request, please contact us directly at pittchaysinee.s@hopscotchvibe.com with the subject line “Data Subject Request”. Include your name, contact details, and a description of your request.

We will acknowledge your request within 7 business days and aim to fulfil it within 30 days, or as required under the PDPA.

We may need to verify your identity before processing any request. In some cases, we may be unable to fulfil a request in full due to legal obligations or other legitimate grounds.

This Privacy Notice is governed by the laws of Thailand, including the Personal Data Protection Act B.E. 2562 (PDPA).
